Utah summoned Kalshi founders Tarek Mansour and Luana Lopes Lara to face 14 criminal charges on Dec. 4 in Salt Lake City court. Sporttrade gained CFTC DCM status after its DCO approval, enabling sports event contract leadership and broker onboarding. These steps highlight ongoing clashes between federal derivatives rules and state gambling bans.
SCCG Take — Federal registration does not shield operators from state criminal liability in prohibitive jurisdictions like Utah. Platforms must map layered risks before scaling liquidity.
Utah has summoned Kalshi co-founders Tarek Mansour and Luana Lopes Lara to face criminal charges in state court. The action coincides with the CFTC granting Sporttrade designated contract market status, completing its shift to a federally regulated sports prediction markets exchange. According to reporting by SBC Americas, these moves illustrate the persistent friction between state gambling prohibitions and federal derivatives oversight.
Utah Attorney General Derek Brown filed felony charges and one misdemeanor count against the company in late October, naming Mansour and Lara as co-defendants. The executives must personally appear in Salt Lake City's Third District Court on December 4 at 8:30 a.m. for initial arraignment.
The criminal case follows Utah's separate civil enforcement action against Kalshi and two Susquehanna trading firms. A federal court had denied Kalshi a preliminary injunction against state officials. The CFTC then petitioned for an injunction against Utah on October 26. State investigators determined that residents could open accounts and trade sports prediction markets, violating Utah's constitutional ban on all real-money gambling.
This multi-front litigation creates immediate compliance risk for any platform offering event contracts in prohibitive jurisdictions.
The CFTC approved Sporttrade as a designated contract market after its mid-October approval as a derivatives clearing organization. The dual registration allows the former peer-to-peer betting exchange to list, process, clear event contracts on its own platform, clear other DCM trades, and partner with futures commission merchants and introducing brokers.
Sporttrade is already onboarding brokers with national distribution, including Fliff, as part of a targeted pipeline. Founder and CEO Alex Kane stated: "Receiving our DCM and DCO registrations from the CFTC is a true full-circle moment for our company." He added that the company was founded on the principle that sports markets deserve the same high-performance structure, tight pricing, and regulatory integrity as traditional financial markets.
STX similarly secured DCM and DCO approvals this week for its subsidiaries, while PredictIt filed a new application for exchange status. These federal steps occur even as Hollywood studios have directed employees to avoid prediction markets on studio earnings or release dates to prevent insider trading.
The Federal-State Tension Ahead
Prediction market operators holding CFTC registrations still face criminal exposure in states that classify event contracts as illegal gambling. Resolution will require either clearer federal preemption or targeted state legislation; absent that, platforms must weigh liquidity gains against enforcement actions that reach individual executives.
