Argentina has not decided its regulatory approach to prediction markets. CNV President Roberto Silva said jurisdiction must first be clarified, with any financial framework likely excluding minors and sports events. This follows the March judicial block of Polymarket for operating without authorisation.
SCCG Take — Regulatory indecision sustains uncertainty for operators and leaves judicial blocks in place. Resolution on CNV jurisdiction will determine viable market entry paths.
Argentina has not decided how to approach prediction markets. Roberto Silva, president of the National Securities Commission (CNV), said authorities must first establish whether the CNV has jurisdiction. The remarks, delivered at an event organised by the Argentine Institute of Finance Executives in Córdoba, were relayed by news agency Nuevas Palabras.
As reported by Nuevas Palabras on 22 October, Silva's comments were conditional. They did not announce an adopted framework. If Argentina pursued a financial-market approach, it would probably exclude minors, sports and certain other events. The government is weighing gambling treatment against potential CNV supervision. No course has been decided. Silva also referenced existing judicial measures.
Buenos Aires City’s judiciary ordered Polymarket blocked throughout Argentina following an investigation into its operation without gambling authorisation. The Public Prosecutor’s Office announced the measure on 16 March. Judge Susana Parada of Court No. 31 issued the order.
The probe began with a complaint from the Buenos Aires City Lottery (LOTBA) and was led by specialist gambling prosecutor Juan Rozas. The platform was characterised as an unauthorised online betting operation presented as a prediction market. Investigators identified a lack of identity and age verification, allowing accounts to be created within minutes.
The court directed Google and Apple to remove and restrict access to the apps nationwide. The Association of State Lotteries of Argentina (ALEA) confirmed that Polymarket held no authorisation in any Argentine jurisdiction.
Silva’s comments leave open whether some prediction contracts could receive different regulatory treatment. The reporting identified no timetable for a decision or any change to the judicial measures against Polymarket. Platforms face continued ambiguity on compliance pathways until jurisdiction and classification are resolved.
