SCCG Take — The case underscores execution risks in supplier recruitment controls and whistleblower protections. Regulators and operators will likely examine vendor compliance programs more closely as a result.
A lawsuit filed in the Eastern District of Pennsylvania accuses Evolution of maintaining a policy that directed recruiters to hire only young, attractive white females. Former Talent Acquisition Manager Marlio Escobar claims supervisors rejected viable candidates on the basis of age, race, ethnicity and sexual orientation. Escobar says he faced retaliation after raising the issue.
Escobar joined Evolution in Philadelphia in 2021. He first identified the practices in February 2023. Supervisors instructed the team to target “young, attractive, white female applicants with no children, and particularly college students.”
Escobar complained to the HR director in March 2023. He supplied several hundred video-recorded interviews and auditions as evidence of systematic rejection of qualified candidates based on protected characteristics. The complaint states that management doubled down on the preferred profile after the report.
Hundreds of applicants were turned away on discriminatory grounds. Escobar then experienced verbal abuse and a hostile work environment. Evolution terminated his employment in May 2023 for alleged poor performance despite no prior warnings or disciplinary records.
Escobar filed a Charge of Discrimination with the U.S. Equal Employment Opportunity Commission and the Pennsylvania Human Relations Commission in July 2023. The suit seeks damages for lost pay, emotional distress, embarrassment and reputational harm.
Similar lawsuits have surfaced this year in the same jurisdiction. Adam Stoerrle alleged Mount Airy Casino Resort racially discriminated against him as a white male and terminated his employment after he reported it. Felton Davis brought a racial discrimination and wrongful dismissal claim against Caesars Palace in April.
According to reporting by Casino Beats, the Evolution complaint arrives alongside separate allegations that executives knowingly supplied services to illegal markets. The cases remain pending.
