The Texas Senate has advanced SB517—a bill that, while clearly aimed at curbing illegal game rooms and “eight-liner” machines, may have wider implications for the sweepstakes gaming sector. As the bill moves to the House for further debate, its language and scope deserve close scrutiny from all stakeholders in the sweepstakes industry.

Why This Bill Matters to the Sweepstakes Industry

SB517’s primary goal appears to be cracking down on illegal gambling activities associated with physical “game rooms” across Texas. These venues, often filled with so-called eight-liners or maquinitas, have become the focus of law enforcement due to recurring issues with unlawful cash payouts and loosely regulated operations.

However, the concern for the sweepstakes industry is in the bill’s broad language—particularly its redefinition of a “gambling device” and a “thing of value.” The updated definitions state that a gambling device includes any device that provides a player, in exchange for consideration, the chance to receive any thing of value, even if the outcome is determined in part by skill.

That “thing of value” now explicitly includes “gift cards” or “any representation of value redeemable for property or money.” This is where it gets tricky. The dual currency system of sweepstakes casinos—offering virtual currency alongside sweepstakes entries redeemable for prizes—could potentially be interpreted as falling within these broadened definitions.

The Larger Trend: Anti-Sweepstakes Bills Nationwide

SB517 isn’t happening in a vacuum. In 2024 alone, at least 11 states introduced legislation that either directly or indirectly targets sweepstakes casinos. Some—like Montana—have gone so far as to redefine “internet gambling” to include platforms that involve wagers and payouts in any form of currency, which would effectively include sweepstakes models.

While bills in Florida, Mississippi, Maryland, and Arkansas failed, the intent behind them sends a strong message: regulators are paying close attention to alternative gambling formats. New Jersey’s debate on a similar bill included direct criticisms of sweepstakes casinos, with officials calling for tighter definitions and enforcement.

Focus on Texas: From Game Rooms to Gray Areas

In Texas, gambling remains tightly regulated outside of horse racing, charitable bingo, the lottery, and a handful of tribal operations. SB517 is likely a response to the growing number of game rooms that push legal boundaries with cash or gift-based prize systems.

But again, the bill’s language—especially phrases like “any device,” “any consideration,” and “any thing of value”—opens the door to broader enforcement interpretations. The concern is whether regulators may, intentionally or not, begin applying this legislation to online sweepstakes platforms that use virtual currency systems akin to those already under scrutiny.

If SB517 becomes law, Texas regulators could be emboldened to pursue cases against online sweepstakes platforms—even those operating within legal gray areas—under the argument that they fall within the newly expanded definition of gambling devices.

What Comes Next?

The Texas legislative session concludes on June 2. Until then, operators, platform providers, and industry stakeholders will be watching closely. Much depends on how the bill is interpreted by regulators and how aggressively it’s enforced. If SB517 becomes law, it could set a precedent for other states looking to tighten control over emerging forms of gambling and sweepstakes operations.

But the broader takeaway is this: sweepstakes casinos are not being ignored. They are increasingly being viewed as part of the larger regulatory conversation on gambling—alongside offshore sportsbooks, eight-liners, and unlicensed online casinos.
