
A father has initiated a wrongful death lawsuit against Argosy Casino Hotel & Spa Kansas City, PENN Entertainment, Gaming & Leisure Properties Inc., GLP Capital, Missouri Gaming Company, and the woman responsible for his son’s death in a car accident.
Emily Davis, 25, hit Xavier Anderson, also 25, around 5:30am on September 16, 2024, while he was cycling on NW Tullison Road, shortly after she left the casino. He was pronounced dead a few hours later.
At the scene, Davis failed sobriety tests and recorded a blood alcohol level of 0.164, over twice the legal limit. She admitted to drinking from 10pm to 2am.
In the lawsuit, Anthony Anderson, Xavier’s father, claims Argosy employees were aware that Davis was “visibly intoxicated” but continued serving her and allowed her to drive instead of arranging a cab. She allegedly showed signs of drunkenness like slurred speech, impaired coordination, and “mental dysfunction.”
“This is about justice for the family and Xavier Alexander,” Anderson’s lawyer, Lee R. Hardee III, stated. “We are actively gathering additional information and intend to pursue full accountability.”
Davis has pleaded guilty to driving while intoxicated resulting in another person’s death and received a ten-year prison sentence. Anderson is seeking $25,000 in damages.
